35 U.S.C. 102: First-Inventor-to-File System

This version of 35 U.S.C. 102 is effective March 16, 2013 and applies to all applications with an effective date on or after that date. It also applies to all the claims of an application when one or more of the claims has an effective date on or after March 16, 2013. 

The main difference with this system is that the right of a patent for a given invention lies with the first person to file the patent application, regardless of the date of the invention.

There are 4 subsections of this version of 102 (called the AIA version). Keep in mind that this version of 102 replaces the older version for applications with a claim that has an effective date on or after March 16, 2013.
